Terms of Service

Effective September 17, 2026

These terms govern your use of PackaTag websites, accounts, QR tags, alerts, recovery rooms, and related services. By creating an account, registering a tag, or using the service, you agree to these terms.

1. Eligibility and accounts

You must be at least 18 years old, or have permission from a parent or legal guardian, to create an owner account. You are responsible for accurate account information, the security of your sign-in credentials, and activity under your account. Notify us promptly if you suspect unauthorized access.

2. Registering and transferring tags

A PackaTag can be registered only when it is available. You may not register a tag attached to property you do not own or have authority to manage. Deregistering a tag removes it from your account and may allow another person to register it. PackaTag is not responsible for a transfer or deregistration made from an account that was accessed without authorization.

3. Recovery service

PackaTag provides communication and notification tools. We do not track an item's continuous location, guarantee that an item will be found or returned, verify the identity or statements of a finder, take custody of property, or arrange transportation or payment between users.

Owners and finders are responsible for deciding how to exchange an item. Use a staffed public location when possible. Do not enter a private residence, share unnecessary personal information, send money, or take an action that feels unsafe. Contact local authorities or venue staff when appropriate.

4. Acceptable use

You may not use PackaTag to harass, threaten, defraud, impersonate, track people without consent, register stolen property, interfere with the service, distribute malware, scrape data, reverse engineer security controls, or violate law. You may not upload or send unlawful, abusive, deceptive, or privacy-invasive content.

5. User content and support access

You retain ownership of messages and other content you submit. You give PackaTag a limited license to host, process, transmit, and display that content as needed to operate, secure, and support the service. Authorized administrators may review recovery records and messages when reasonably necessary to investigate a reported problem, prevent abuse, protect users, or comply with law.

6. Alerts and third-party services

Delivery of email, push, location, authentication, hosting, and other features may depend on third-party providers and device settings. Alerts can be delayed, filtered, or fail. You remain responsible for keeping contact information current and checking your account.

7. SMS Terms

PackaTag offers optional transactional SMS recovery alerts. If you enter and verify a mobile number and explicitly enable text alerts, PackaTag may text you when one of your registered PackaTags is scanned. A message may include the item name, approximate scan location, and a secure link to the private recovery chat. Message frequency varies based on recovery activity. Message and data rates may apply. Consent to receive SMS alerts is not a condition of purchase.

You can opt out at any time by replying STOP. You may reply HELP for assistance or contact support@packatag.com. After opting out, you may reply START and re-enable alerts in your PackaTag account. Mobile carriers are not liable for delayed or undelivered messages. PackaTag does not sell or share SMS opt-in data with third parties for marketing purposes.

8. Physical products

Actual appearance, adhesion, print color, and durability can vary by surface, environment, preparation, and use. Follow the product instructions and test suitability before applying a sticker to a valuable or delicate surface. PackaTag is not responsible for surface damage caused by application, removal, misuse, or normal wear.

9. Service changes and termination

We may change, suspend, or discontinue features and may restrict or terminate access for abuse, security risk, violation of these terms, or legal requirements. You may stop using the service and request account deletion through support.

10. Disclaimers

To the fullest extent permitted by law, PackaTag products and services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant uninterrupted operation, successful notification delivery, accurate location, or recovery of any item. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, PackaTag will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost property, lost data, lost profits, personal injury caused by another user, or an unsuccessful or unsafe exchange. PackaTag's total liability arising from the service will not exceed the greater of the amount you paid PackaTag during the 12 months before the claim or US $100. Applicable law may provide rights that cannot be limited by these terms.

12. Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute that is not required by law to be heard elsewhere will be brought in the state or federal courts serving Ventura County, California. Nothing in these terms prevents either party from seeking relief in small claims court where eligible.

13. Changes and contact

We may update these terms by posting a revised version and effective date. Material changes may receive additional notice. Questions can be sent to support@packatag.com or submitted through our support page.

These terms do not limit consumer rights that cannot legally be waived.
